The team has significant experience of advising on all building safety matters, including the interpretation, application and implementation of the Building Safety Act 2022 (BSA), due diligence on building safety issues throughout transactions, and the resolution of building safety related claims.
The BSA is the most significant legislative and regulatory change to the construction industry in a generation. It imposes obligations and liabilities throughout design, construction and occupation of many built assets and expands liability for building safety defects in historic developments.
We adopt an integrated approach to building safety advice, advising on transactional issues and disputes across the following areas:
- Regulatory advice – interpreting and applying the BSA to projects, advising on the classification of buildings as ‘higher risk’, the obligations of the responsible person and accountable person, and on leaseholder protection.
- Contracts – ensuring that construction contracts, sub-contracts, professional appointments and security documentation incorporates the requirements of the building safety regime.
- Transactions and due diligence – reviewing and reporting on building safety issues for lenders, investors, and on corporate and real estate transactions.
- Historic cladding claims – advising developers, contractors, leaseholders and occupiers of buildings on remediation orders, remediation contribution orders, building liability orders, building information orders and Defective Premises Act 1972 claims.
- Building safety claims – in addition to historic cladding defects, we assist clients mitigate and resolve building safety related claims arising from enhanced rights provided by the BSA.
We are thought leaders on building safety and deliver tailored workshops to clients on building safety related issues.
