Redundancy process was fair and non-discriminatory

A manufacturing company consulted RWK Goodman in relation to a restructuring of its production process.  We supported the company through the restructure, from the planning stage through to the end of the implementation process.  As a result of the restructure, a number of employees were put at risk of redundancy.  One employee alleged that his redundancy was unfair, and that he had been selected for redundancy in xonnection with this age.  In particular, he alleged that a director of the company had said to him that “you can’t teach an old dog new tricks”.  The employee brought claims in the employment tribunal for unfair dismissal and age discrimination.  RWK Goodman instructed a barrister to represent the company at tribunal.  It was commented that the company had followed a ‘textbook’ redundancy process and the dismissal of the employee was entirely fair and non-discriminatory.
