Devastated family win £400k following clinical negligence claim

The family, who cannot be identified for legal reasons, made the clinical negligence claim on the grounds that staff at the Whittington Hospital had diagnosed the illness too late for the woman to receive effective treatment.

The London-based Whittington Hospital NHS Trust had denied liability, but last month agreed to the six-figure settlement.

The family’s legal team said the woman had been told radiology results were “essentially normal” when she went for tests on her right breast in April 2004.

It is alleged that the mum-of-two was denied a referral for a second check later that year.

In 2005, the woman was diagnosed with breast cancer and she died six years later, after the disease spread to her uterus and bones.

Following negotiations outside court, Mr Justice Supperstone confirmed that the parties had agreed a final settlement in the sum of £400,000.
