Successful case against The Whittington Hospital NHS Trust for negligence resulting in cerebral palsy

A boy, who was six years old at the time the claim was settled, has received a lump sum of £3,100,000 plus periodical payments of £128,250 per annum until December 2021, £155,000 per annum until December 2027 and £223,250 per annum thereafter for injuries he sustained during his birth following the negligent management of his delivery at the Whittington Hospital in London in 2008.

Our client suffered hypoxic ischaemic brain damage and, consequently, from severe hypertonic cerebral palsy. He is completely dependant on 24-hour care as he cannot walk, cannot communicate, is doubly incontinent, and PEG fed (through a tube).

The allegations of negligence related to:

  1. a negligent failure to obtain urgent obstetric assessment, particularly after reports of vaginal bleeding;
  2. negligent failure to recognise the need for urgent caesarean section due to placental abruption;
  3. a failure to carry out adequate CTG monitoring of his heartbeat throughout the labour.

The compensation our client has received is managed by the Compensation Protection Unit at RWK Goodman and is designed to provide him with significant levels of care and support in all aspects for the remainder of his life.
