Negotiation, drafting and review of a contract for a new orphan drug

Long standing client from charity sector with a patient data base, came to us with the need for legal advice. It had been approached by a European Pharmaceutical, (EP).

EP wanted to have access to our client’s database in order to obtain approval for their new orphan drug developed to treat patients suffering from a particular syndrome.

We assisted the client with the negotiation, drafting and review of a contract with EP and a German service provider. Because of the nature of the personal information in the database, we had to take the following issues into account:

1. Data protection, including GDPR;
2. Cross Border issues;
3. The drafting of a contract which gave our client the best possible protection.

The contract was agreed in June 2018.
