Claim for former secretary in asbestos factory
Mrs W married her husband Colin in the 1960’s and in 1971 they emigrated to Australia. Mrs W became unwell and was diagnosed with mesothelioma from which she died just before Christmas 2017. Mr W contacted RWK Goodman on (Saturday) 23 December, and we were available to advise him about the merits of his claim and put in applications for benefits and a lump sum from the Government. A letter of claim was sent and medical and financial evidence obtained. Court proceedings were drafted and just before they were served in May 2018 Cape Asbestos admitted responsibility and the Court proceedings were put on hold. No offers were forthcoming and court proceedings were served. The claim was settled for £150,000 in the autumn of 2018.
This claim involved a lot of work out of normal office hours. At RWK Goodman we pride ourselves on our accessibility and availability for example we have a live chat facility on hire. The initial contact from the client was on the last Saturday before Christmas, and we were available to speak to him on that day and to set in train investigations and send him paperwork over the Christmas period. Because of the time difference, much of the contact with Mr W was by email often in the early hours of the morning.
