About Gemma:
Gemma is a Senior Associate in our Health and Social Care team, based in our London office.
Gemma brings with her significant regulatory experience from her work with CILEx Regulation, the Care Quality Commission (CQC) and NHS Improvement. Prior to joining RWK Goodman, Gemma worked for VWV.
Gemma specialises in advising and providing representation to education, health and social care providers on contentious and non-contentious regulatory issues. She uses her experience of working in-house with regulatory bodies to advise and represent organisations in the healthcare and education sectors on regulatory compliance. She has particular expertise in challenging investigations and defending proceedings commenced by regulatory bodies. This includes public law challenges through judicial review proceedings. Gemma provides support to organisations involved in safeguarding investigations and represents organisations identified as interested persons in inquests.
Gemma's experience includes:
- Challenging CQC and Ofsted inspection reports
- Defending against CQC enforcement action (civil and criminal, including health and safety prosecutions)
- Appeals to the First-Tier (Care Standards) Tribunal
- Advising providers in relation to safeguarding enquiries and investigations
- Supporting providers to prepare for and representation at Coroner’s inquests – including Article 2 Inquests and Pre-Inquest Review
- Mounting public law challenges through judicial review proceedings
- Advising providers in relation to fee negotiations
- Acting for an online prescription service in a successful permission application to judicially review the Care Quality Commission. The case involved obtaining an interim injunction until the permission hearing, in order to challenge the CQC’s inspection and factual accuracy process.
