Compensation recovered for wrongful weight loss surgery procedure

Our client, a 30 year old woman, was booked for a weight loss procedure called a Roux-en-Y gastric bypass. However, on the day the hospital made an error and performed the wrong procedure, a far more extensive surgery called biliopancreatic diversion. This radical procedure had serious consequences for the lady’s health, which would otherwise have been avoided.

As a result, our client suffered Dumping Syndrome and severe malnutrition and was no longer able to continue to work. She was also no longer able to carry out normal everyday activities independently and needed a carer to assist her.

Our Clinical Negligence team obtained £350,000 in compensation which included the client’s loss of earnings and costs of the care she now required. Another important part of the compensation was the cost of further therapies and medical treatment needed, as well as the cost of items of equipment she would need to help her better cope with her injuries.
